There is a federal law called the Family and Medical Leave Act (“FMLA”) which covers some New York workers as well as the workers of other states such as New Jersey. In order to be covered by the FMLA, the worker must work for a company that employs at least fifty(50) employees and the worker must have been employed for twelve months and worked at least one thousand-two hundred fifty (1,250) hours during the last year.

A worker can use FMLA leave to take time off for his/her own serious medical condition or to care for a seriously ill child, spouse, or parent.   The FMLA allows an employee to take off up to twelve(12) weeks. The FMLA allows intermittent leave periodically for say chemotherapy treatments or for a leave of absence.

Note that the FMLA does not require that the time off be paid time off.  In addition, if the employee returns to the job in less than twelve(12) weeks, the employee must be returned to his/her same or an equivalent job.
