February 3, 2015, New York, NY – Louis Ginsberg Law Offices is pleased to announce a six million two hundred fifty thousand dollar ($6,250,000.00) Settlement in a Wage and Hour Class Action on behalf of approximately one thousand seven hundred (1,700) current and former hourly employees (“Hourly Employees”) of Riverbay Corp. (“Riverbay”). The Plaintiffs alleged that the Defendants denied straight and overtime compensation to Hourly Employees by: (1) allegedly paying Hourly Employees according to their scheduled hours rather than the actual time they spent clocked in and performing work-related duties; (2) allegedly offering Hourly Employees compensatory time off in lieu of overtime payments in cash; and (3) allegedly failing to include the nighttime differential pay for work at night into the regular rate of pay, thereby allegedly resulting in overtime not computed at the proper time and one-half rate. The Honorable Judge John G. Koeltl of the United States District Court for the Southern District of New York granted Plaintiffs’ Motion for Preliminary Approval of the Settlement.
