Scheduled based pay is when an employer pays an employee based on what their schedule is and not adoring to the hours the employee actually worked. Shaded based pay does not take into account any time that employee’s work before their scheduled shift, after their scheduled Shift or during?eir lunch break, if their lunch break is automatically deducted from their paycheck.
For example, if an employee is shaded to work from 9-5 with a half-hour meal breakfast is automatically deducted, Shaded based pay would be when the employee is paid only for 7.5 hours (8 hours – % hour meal break), regardless of how Ion they actua11y worked during the workday. So if the employee arrives to work early or works past their scheduled end time, and they are not paid for the extra time; an employee can sue for the unpaid wages and/or overtime pay, plus damages for inaccurate wage statements, liquidated damages, attorney’s fees, costs and interest.
