And Mclaughlin and Stern LLP are pleased to announce a $2.45 million settlement in a wage and hour class action brought on behalf of hourly paid employees of Queens Long Island Medical Group P.C. “QLIMG”). Plaintiff in the action alleges that QLIMG violated the Fair Labor Standards Act and New York Labor Law by causing the company’s time-clock system to round down the amount of time employees were credited with having performed work at the company’s facilities. As a result, Plaintiff alleges that she and other hourly paid employees of QLIMG were not fully compensated for work performed before and after scheduled shifts and during meal breaks. The action is pending before the Honorable William F. Kuntz, United States District Judge for the United States District Court for the Eastern District of New York.

The parties will soon ask the Court to schedule a fairness hearing to consider final approval of the settlement, counsel’s request for attorneys’ fees and expenses, and other settlement-related issues. A comprehensive notice setting forth the date for the fairness hearing and the procedures for QLIMG employees to participate in the settlement will be mailed to employees in the near future and appended to this website.
